All software used on this site is the property of Mercury Solutions Sdn Bhd or its software suppliers and protected by Malaysia and international copyright laws. The content on this Site is only for the purpose of shopping on this Site or placing an order and for no other purpose. Any other use, including, modification, reproduction, uploading, posting, transmission, or distribution in any form or by any means, without Mercury Solutions Sdn Bhd’s prior written permission, is strictly prohibited. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, MERCURY SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 3. Typographical Errors
In the event a product price is listed incorrectly due to typographical error, error or change in pricing information received from our vendors, Mercury Solutions Sdn Bhd shall have the right to refuse or cancel any orders placed for product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase containing items that have been incorrectly priced, Mercury Solutions Sdn Bhd will either refund or charge you for the difference between the correct price of the products and incorrectly listed price for the products.
4. YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are a child or under 21 years old, you may still purchase items from Mercury Solutions Sdn Bhd but only with the involvement of an adult or guardian. Mercury Solutions Sdn Bhd and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

You should be aware that the information might contain errors, omissions, inaccuracies, or outdated information. Mercury Solutions Sdn Bhd makes no representations or warranties as to the completeness, accuracy, adequacy, currency, or reliability of any information and shall not be liable for any lack of the foregoing. Descriptions of, or references to, products within this Site does not imply endorsement of that product.
6. Term of Use Revisions
Mercury Solutions Sdn Bhd may at any time revise these Terms of Use by updating this posting. By using this Site, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms of Use to which you are bound.
7. Title
Title to Products remains with Mercury Solutions Sdn Bhd until all amounts payable in respect of Products to Mercury Solutions Sdn Bhd by Customer is received in full by Mercury Solutions Sdn Bhd. Risk in Products shall pass from Mercury Solutions Sdn Bhd to Customer upon delivery of Products to Customer.
8. The Transaction
8.1 No contract shall exist until Customer's order is accepted by Mercury Solutions Sdn Bhd. This website is an Invitation to Treat. Orders which have been accepted shall have its status updated to "Processing".
8.2 Notwithstanding Clause 8.1, , in the event that the Customer repudiates the contract ,after acceptance by Mercury Solutions Sdn Bhd, by cancelling or amending the order, Mercury Solutions Sdn Bhd may at its absolute discretion impose an administrative charge on the Customer for any loss occasioned by the repudiation.
8.3 Mercury Solutions Sdn Bhd has no obligation to deliver Products until the Price and any other applicable charges is received in full by Mercury Solutions Sdn Bhd in the currency in which the Price is quoted to Customer by Mercury Solutions Sdn Bhd or in the absence of such a quotation in the currency in which the Price appears in Mercury Solutions Sdn Bhd's price list on the date of the Agreement.
8.4 All stated promotional gifts given are subjected to availability and allocated on a first come first serve basis.
8.5 Mercury Solutions Sdn Bhd reserves the right to refuse to accept an order from a Customer without reason or prior notice.
8.6 All orders are subjected to stock availability. Mercury Solutions Sdn Bhd reserves the rights not to fulfill or cancel an order in the event that stocks are unavailable.
9. Cancellations
9.1 An administrative charge of 15% of the total cost of the order will be imposed for cancellations of orders which have been confirmed via e-mail or phone by the Customer. Such orders will have their status updated to "Processing".
10. Product Acceptance
Unless Customer notifies Mercury Solutions Sdn Bhd to the contrary by seven (7) days after the delivery of Products, products shall be deemed to have been accepted by Customer in good condition and in accordance with the Agreement.
11. Feedback
We welcome feedback on how we can improve our services. You can contact us directly should you have any complaint.
12. Governance and Jurisdiction
This TOS shall be governed and construed in accordance with the laws of the Republic of Malaysia and it is hereby irrevocably agreed for the exclusive benefit of Mercury Solutions Sdn Bhd that the courts of Malaysia are to have exclusive jurisdiction to settle any disputes that may arise out of or in connection with The Service and that accordingly any writ, action, or proceeding arising out of or in connection with this TOS (hereinafter called "Proceedings") may be brought in such courts. Nothing in this clause shall limit the right of Mercury Solutions Sdn Bhd to take Proceedings against Users in any court of competent jurisdiction, nor shall the taking of Proceedings in one or more jurisdictions preclude the taking of Proceedings in any other jurisdictions, whether concurrent or not.
